Myth vs Reality: Lawyers, Judges, the Court with Attorney Limor Mojdehiazad

Let’s start with Judges. They will almost never rule in the way you project they will rule – totally in your favor. Why? Because they have a Guidebook by which they are given options in rulings for any point of law, because all rulings are based on law, not how you make them feel with your story and why you want what you want. For example, a couple is getting divorced and they have an infant. Because the mother is breastfeeding, most mothers think that the Judge will see the child being with them 24/7 for a few years the only reasonable way to rule. Alas, most are disappointed to find out that Judges will say, “Pump milk and give it to Dad for his overnight time with the child.” The supporting legal concept would be “Best Interest of the Child” to be with both parents and bond equally.
You can do research on the Judge to get an idea of where the Judge might go in decisions that affect your case. Judge’s rulings can be found on the Internet, as can reviews of the Judge be found online by people who appeared before him/her. Know the law and you will have an inkling about the Judge’s ruling.
Attorneys: Scary to live with them yet can’t live without them when you really need them. But are they all what you need them to be: Honest, Ethical, Caring about spending your money, and concerned that they may be adding to your emotional demise by their representation? Don’t get me wrong, there are some fabulous attorneys who want to preserve the sanctity of your welfare as you go through divorce and only do what is necessary for good, sound representation, and strive to make the financial investment no more than it needs to be.
There are too many attorneys, though, who only see dollar signs. These attorneys will drag out a case with unnecessary work just to increase their financial take on your unfortunate circumstances. Eventually their client see this, but it’s only after too many thousands have been fruitlessly spent. I know of a person going through divorce who told me that the divorce started amicably, settlement arrived at mutually before the filing began, only to be told by their attorneys – who were friends – that the couple should not speak to one another throughout the proceedings and exclusively speak through their attorneys! Outrageous!! My counter to this was, “Well, if there were minor children to co-parent, the parents couldn’t speak to one another about the kids? They would have their attorneys be part of the co-parenting?” That’s how crazy it can get if you have attorneys who only see you and your divorce as a money pit.
And the Court system: It’s there for people who can’t get along, can’t speak to each other, and who can’t give each other mutual respect. Or for people who are married to someone who only wants to destroy them. Mediation didn’t work. Attorneys holding settlement conferences didn’t work. And lighting candles for a novella failed, too. That’s what trials are for. Come prepared. Know the law. Have your ducks in a row, and let the shooting begin.
It only takes one spouse to make a contentious situation the best it can be. Don’t engage in reprehensible behavior. Be strong. Look at all sides of an issue and have options available. Fire your attorney if you’re not confident that they’re giving you the best representation and counsel possible. And if something doesn’t work out exactly as you want it to, you can always appeal.

Limor was born in Israel and grew up in Los Angeles. She has a natural ability to put her clients at ease and lend support when its needed. Her tenacious personality, relentless negotiation skills, and understanding of the law help her achieve excellent results for her clients. Prior to opening her own law office in 2018, Limor practiced family law at two other private firms in Los Angeles County, Bet Tzedek Legal Services and, Legal Aid Foundation of Los Angeles, and the Harriet Buhai Center for Family Law. She continues to volunteer at the Harriet Buhai Center on a monthly basis to serve the indigent in need of family law services.
